Judicial Privacy Law Trailer Legislation Updates
The Judicial Privacy Law trailer legislation, 2025 Act 25, was enacted by the State Legislature and signed into law by the Governor on August 8, 2025. This act addresses the primary concerns of the Wisconsin Land Records Profession with the Judicial Privacy Law (2023 Act 235). Act 25 reduces the burden to stakeholders while preserving the original policy intentions. These changes were enacted as practical solutions to identified issues and uncertainties raised by WLIA, WCA, WRDA, PRIA Local, LION, and many other groups. With that said, government agencies continue to have many challenges in implementing the Judicial Privacy Law.
Attolles Law, on behalf of the Wisconsin Counties Association, has recently released a legal analysis of the amendments to Act 235, to help you better understand how these changes may impact you and your organization. We encourage you to read this legal analysis to understand how Act 25 may affect your organization.
The Judicial Privacy Task Force, jointly with the WLIA Legislative Committee, worked tirelessly over this last year to help create and lobby for this trailer legislation, which has significantly decreased the impact of the Act 235 on Land Records Professionals. The Judicial Privacy Task Force is expected to finish its work and submit a final report in the near future. Please let us know if you have any questions or concerns.
This is NOT legal advice. It is intended to help state and local agencies understand the common compliance considerations related to WI 2023 Act 235, 2025 Act 25, and land records. Agencies should seek legal opinions from their legal counsel and risk management professionals.
